Acceptable Usage Policy

This Acceptable Usage Policy ("AUP") applies to all customers and users of Fix24.cloud, a brand of Datamation Group ("Fix24", "we", "us"), and governs the use of our cloud hosting, VPS, dedicated/managed servers, storage, backup, VPN, and related infrastructure Services. It is incorporated by reference into our Terms of Service. Violation of this AUP may result in warning, suspension, or termination of Services, at our sole discretion, with or without notice depending on severity.

1.Purpose

This AUP exists to protect the security, integrity, and performance of our network and infrastructure, safeguard other customers, and ensure our Services are used lawfully and responsibly. It is not exhaustive — we may take action against any use of our Services that we reasonably believe threatens our network, reputation, or other users, even if not explicitly listed below.

2.Prohibited Content

You may not use our Services to store, host, transmit, or distribute:

  • Content that infringes copyright, trademark, patent, or other intellectual property rights;
  • Malware, viruses, ransomware, or any code designed to damage, disrupt, or gain unauthorized access to systems;
  • Phishing pages, fraudulent schemes, or content impersonating another person or organization;
  • Child sexual abuse material (CSAM) or content exploiting minors — reported immediately to relevant authorities;
  • Content that is defamatory, obscene, or promotes violence, terrorism, or hate speech;
  • Content that violates applicable Indian law, including the Information Technology Act, 2000, and rules made thereunder; and
  • Unlicensed gambling, illegal pharmaceuticals, or other content prohibited under applicable law.

3.Prohibited Activities

You may not use our Services to:

  • Send unsolicited bulk email (spam), or operate open mail relays or spamming infrastructure;
  • Conduct port scanning, vulnerability probing, or unauthorized penetration testing of systems you do not own or lack written authorization to test;
  • Launch or participate in denial-of-service (DoS/DDoS) attacks, brute-force login attempts, or any activity that disrupts other networks or services;
  • Engage in cryptocurrency mining that breaches your plan's resource limits or degrades shared infrastructure, unless explicitly permitted by your plan;
  • Spoof IP addresses, headers, or other identifying information with intent to deceive or evade detection;
  • Attempt to gain unauthorized access to any system, account, or network, whether ours or a third party's; or
  • Resell or sublease Services in violation of your plan's terms, or misrepresent your relationship with Fix24.

4.Resource Usage & Fair Use

Shared and cloud plans are subject to fair-use resource limits (CPU, RAM, I/O, bandwidth) as described in your plan. Sustained resource usage that materially impacts the performance of shared infrastructure or other customers may result in throttling, a request to upgrade to a higher-resource plan, or migration to a dedicated/VPS environment. Unlimited or unmetered plans are subject to the fair-use thresholds disclosed at the point of sale.

5.Network & Email Abuse

All outbound email must comply with applicable anti-spam laws and include a functioning unsubscribe mechanism for bulk/marketing mail. We may monitor aggregate network traffic patterns (not content) for security and abuse detection. Accounts generating a high volume of spam complaints, blacklist listings, or abuse reports may be suspended pending investigation.

6.Security Responsibilities

On unmanaged Services, you are responsible for keeping your operating system, applications, and scripts patched and secure. Compromised servers (e.g., due to outdated software or weak credentials) that are actively attacking other systems or sending spam may be suspended immediately to contain the incident; we will notify you as soon as reasonably possible and assist with remediation.

7.Monitoring & Enforcement

We do not routinely monitor the content of Customer Data, but we may investigate activity on our network in response to abuse complaints, security alerts, or legal requests, and may take reasonable steps to verify compliance with this AUP. Actions we may take for violations include a warning, temporary suspension, content removal, permanent termination, and/or reporting to law enforcement, depending on the severity and recurrence of the violation.

9.Changes to This Policy

We may revise this AUP from time to time to address emerging threats or regulatory changes. Material changes will be posted on this page with an updated date, and where appropriate, communicated to active customers via email.
