Fix24.cloud ("Fix24", "we", "us") respects the intellectual property rights of others and expects our customers to do the same. This policy explains how rights holders can submit a copyright infringement notice for content hosted on our infrastructure, consistent with the notice-and-takedown approach of the U.S. Digital Millennium Copyright Act (DMCA) and applicable provisions of Indian copyright and IT law.
1.Filing a Takedown Notice
If you believe content hosted on our network infringes your copyright, send a written notice to support@fix24.cloudwith the subject line "DMCA / Copyright Notice" including:
- Identification of the copyrighted work you claim has been infringed;
- The exact URL(s) or location of the allegedly infringing material;
- Your contact information (name, address, phone number, email);
- A statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law;
- A statement, made under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner; and
- Your physical or electronic signature.
2.Our Process
Upon receiving a complete and valid notice, we will forward it to the customer responsible for the content and may remove or disable access to the material pending resolution, consistent with our role as a hosting provider. We aim to acknowledge valid notices within the timeframes in our SLA.
3.Counter-Notification
If you believe content was removed or disabled in error or misidentification, you may submit a counter-notice to support@fix24.cloud including: identification of the removed material and its prior location; a statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification; your contact information; and your consent to the jurisdiction of the applicable courts. We will forward valid counter-notices to the original complainant.
4.Repeat Infringers
We reserve the right to suspend or terminate the accounts of customers who are subject to repeated, valid infringement notices, in accordance with our Acceptable Usage Policy.
5.Misrepresentation
Submitting a knowingly false or bad-faith takedown or counter-notice may expose the submitting party to liability under applicable law. Please ensure your notice is accurate before submitting it.
